Rakouské vypořádávání se s Looted Art

Abstract

Cílem této prezentace je představit komparační část dizertačního výzkumu zaměřující se na porovnání rakouské a české právní úpravy restituce Looted Art. Po historickém úvodu, popisujícím společenskou situaci před anšlusem, byly krátce zmíněny instituce provádějící arizaci, které byly replikovány na většině okupovaných územích. Následně byly kriticky zhodnoceny poválečné restituční předpisy a tyto porovnány s českou právní úpravou. Pozornost pak byla zaměřena na vývoj v 90. letech, především na kauzu "Wally", přijetí restitučního zákona BGBl I 1998/181 a na něj navazující kauzu "Dámy ve zlatém".

The aim of this presentation is to discuss the comparative part of the dissertation research focusing on the comparison of Austrian and Czech legislation on the restitution of Looted Art. After a historical introduction, describing the social situation before the Anschluss, the institutions carrying out the aryanisation, which were replicated in most of the occupied territories, were briefly mentioned. Subsequently, the post-war restitution regulations were critically evaluated and compared with the Czech legislation. Attention was then focused on developments in the 1990s, especially the "Wally" case, the adoption of the restitution law BGBl I 1998/181 and the subsequent case of the "Woman in Gold".
