Rakouský přístup k navrácení kulturních statků odňatých v období nacismu

Abstract

Cílem této přednášky je právně-historický rozbor rakouské úpravy restituce kulturních statků po II. světové válce. Přestože je důraz kladen jak na historickou, tak současnou právní úpravu, pozornost je věnována také společenským souvislostem a historickým okolnostem, za kterých byly konkrétní právní předpisy přijímány. Závěrečná část se pak zaměřuje na případ restituce obrazu Gustava Klimta Dáma ve zlatém, který mimo jiné otevřel cestu k podávání žalob na území Spojených států amerických proti státům spravujícím Nazi-Looted Art ve svých sbírkách.

This presentation is a legal analysis of how Austria regulated the restitution of cultural property after World War II. Therefore, its focus lies on both historical and contemporary legislation, also considering the social context and historical circumstances under which specific legislation was adopted. The final part is dedicated to the exemplary case of the restitution of Gustav Klimt's painting The Woman in Gold, which, among other things, opened up a way to file lawsuits in the U.S.A. against foreign states holding Nazi-Looted Art in their collections.
