Abstract

Tento příspěvek se zaměřuje na teoretické základy mikro a makro řízení sporů o peněžitáplnění v českém civilním procesu. Hlavním konceptem je zde case management, což jemoderní přístup, který klade důraz na aktivní roli soudu i stran při vedení řízení, čímžpostupně nahrazuje tradiční přístupy.

It analyzes thebasic concepts of civil procedure and economicmodels that influence the application of casemanagement, with an emphasis on the proportionalityof the proceedings depending on thenature and value of the dispute. Furthermore,it deals with proposals for managing disputesat both micro and macro levels, including toolsfor conducting an effective and predictable legalprocess.
