Mikro a makro řízení sporů o peněžitá plnění - základy empirického přístupu

Abstract

Rozhodování civilních sporů o peněžitá plnění představuje v soudnictví komplexní proces,jehož dynamika a efektivnost je závislá na použitých nástrojích case managementu, tedyvedení řízení soudem a součinnost účastníků. Tento článek přináší analytický pohled na základníempirická zjištění z praxe českých soudů a zaměřuje se na možnosti rozlišování různýchtypů sporů - bagatelních, spotřebitelských, obchodních a civilních - a jejich specifickécharakteristiky a navrhuje na základě empirických zjištění modely těchto typových sporůi z hlediska diferencovaného využití nástrojů case managementu.
