Preventive Business Restructuring in Europe - First Experiences in a Comparative View

Abstract

This conference proceedings volume, from a conference held in November 2025, describes the approaches of various European jurisdictions to the transposition of EU Directive No. 2019/1023, the Directive on Restructuring and Insolvency. The proceedings examine the transposition carried out in the Czech Republic, Germany, the Netherlands, Poland, Spain, and France. They highlight not only the current state of national legislation but also the differences observed in certain jurisdictions, and in some cases describe the various types of proceedings permitted under national regulations.
